GENERAL TERMS AND CONDITIONS OF SALE (GTCS)

These GTCS govern sales concluded between Helco SA (Coco-Mat Switzerland) and its customers via the website www.cocomat.ch or in-store. Any order implies full and unconditional acceptance of these terms.

ORDERS The order becomes final upon validation on the payment page. A confirmation is sent by email. In the event of unavailability of an item, only the available part will be delivered.

PRICES AND PAYMENT TERMS Prices displayed on the website are indicative at the time of display. The contractual price is the one indicated in the order confirmation email, sent after the order has been validated.

Unless otherwise stated, prices are expressed in Swiss francs (CHF), including VAT, and exclude delivery, packaging, installation, or additional service fees, which are specified in the order confirmation.

Full payment is a prerequisite for the release of any goods.

In the event of cancellation by the Buyer, Helco SA reserves the right to retain any deposit paid. Any potential refund is at the sole discretion of Helco SA.

DELIVERY METHODS The Buyer may choose one of the following delivery methods:

·       Click & Collect: online order, secure payment, pickup at our Coco-Mat store in Geneva.

·       Home Delivery: online order, delivery to the address specified at the time of ordering.

Product availability is confirmed by email, which triggers the conclusion of the sales contract. This confirmation may be partial depending on actual availability. In such cases, only confirmed items will be delivered.

Delivery charges are calculated for the entire order. Delivery may be made in several packages.

Delivery times and dates are indicative unless otherwise agreed in writing. The Buyer is responsible for ensuring that the delivery location is accessible. Any discrepancy in quantity or visible damage must be reported immediately upon receipt.

Goods remain the property of Helco SA until full payment has been received. The Buyer must take proper care of the goods until that time.

DELIVERY TIMES

·       In-stock items: Orders for items available in stock are generally delivered within 7 to 12 business days in Switzerland.

·       Custom-made or made-to-order products: Certain items, such as furniture or personalized bedding, are made to order. The average delivery time for these products is 9 to 12 weeks, depending on the type of product and the time of year. These delivery times are indicative and may be extended in exceptional circumstances (production or transport delays, etc.).

A 50% deposit is required for all custom product orders. Production begins only after receipt of this deposit. The balance is due before delivery.

If a custom order is cancelled after production has begun, Helco SA reserves the right to retain the deposit paid, even if the product has not yet been delivered.

RIGHT OF WITHDRAWAL AND REFUND In accordance with Swiss law, no automatic right of withdrawal is granted. However, Coco-Mat Switzerland grants its customers a 14-day period from receipt of the products to exercise their right of return.

Applicable conditions:

·       The item must be unused, unwashed, in its original condition, and returned in its original packaging with all accessories and tags.

·       Proof of purchase (invoice or order confirmation) is required.

·       Returns may be made in-store or by post.

Exceptions: The following items cannot be returned or exchanged:

·       Pillows, duvets, sheets, protectors (for hygiene reasons),

·       Personal care products (cosmetics),

·       Discounted or customized items,

·       Gift cards.

Return shipping costs are the responsibility of the Buyer, except in cases of incorrect or defective products.

Refund: After receipt and inspection of the returned product, a refund will be issued within 10 to 14 business days by bank transfer, excluding original handling and shipping fees. In the event of non-compliant returns, the product may be returned to the Buyer at their expense.

LEGAL WARRANTY In accordance with the Swiss Code of Obligations (Art. 197 et seq.), any defect must be reported within 10 days. In the case of a major defect, you may request repair, exchange, price reduction, or refund.

PAYMENT METHODS Credit cards (Visa, Mastercard issued by a Swiss bank), cash (in-store in Geneva), or bank transfer. Helco SA may exclude certain payment methods.

DATA PROTECTION

Coco-Mat Switzerland is committed to respecting the privacy of its customers. Personal data collected via www.cocomat.ch or in-store is processed in accordance with the Swiss Federal Data Protection Act (FADP) and, where applicable, the General Data Protection Regulation (GDPR).

Data collected:

·       Contact information (name, address, email, phone),

·       Payment information,

·       Order details and purchase history,

·       Website navigation and usage data.

Purposes:

·       Execution of orders and contracts,

·       Customer relationship management and after-sales service,

·       Personalization of services,

·       Legal obligations (accounting, tax),

·       Security and fraud prevention.

Retention: Order-related data is retained for 10 years in accordance with Swiss tax legislation.

Sharing: Data is shared only with trusted service providers (payment, delivery, hosting, Shopify). These providers are contractually bound to confidentiality.

Individual rights: Each customer may exercise their rights of access, rectification, deletion, objection, or restriction of data processing by writing to: geneva@coco-mat.ch

Shopify, as the provider of our website, is certified under the EU-U.S. Data Privacy Framework.

DISPUTES Jurisdiction: Courts of the canton of Vaud. The client may also contact a mediation platform or the Swiss Consumer Commission.
